Terms and Conditions

  1. You acknowledge that you are 18 years of age or older. Simple Climb services are strictly unavailable to children under the age of 18. If a child under the age of 18 has provided us with their information without a consenting parent/guardian, please contact us immediately.
  2. Simple Climb is not affiliated with Instagram, Facebook or any Instagram third-party partners in any way. If this ever changes, we pledge to notify all our users.
  3. It is your sole responsibility to comply with Instagram rules and any legislation that you are subject to. You use Simple Climb at your own risk.
  4. There is no perfect defense against spam, fake accounts, and whatever other new engines of malice and profit may turn up in the future. But you are always in control of your account and your content. What we do is bring attention of real users to your feed and your content. You can remove, mute or block any user, at any time. Using Simple Climb’s services, you acknowledge your full agency and control over your account, and thereby indemnify Simple Climb from any misadventures your may find your account involved in, including but not limited to, being banned, blocked, or suspended. Remember – you are always in control – your vigilance and good will while using your social media accounts are your best defense against negative consequences. Our will is good, and our methods of curation and automation will remain vigilant while you use our services, to continually bring your content to the attention of real, authentic and engaged users.
  5. We are not responsible for your actions and their consequences. We are not liable if your Instagram account is blocked or banned for any reason.
  6. We require your Instagram username and password to obtain required information for Instagram. We will never give away, sell, share, or distribute your password to any third parties, for any reason.
  7. The expected amount of followers, likes and comments is not guaranteed to you in any way. It all depends on the quality of your content.
  8. In no event will you claim that Simple Climb has any liability for lost profit, revenue, or any other damages. Our services are always a best-effort offering, and no promise of performance should be inferred or assumed.
  9. We can’t guarantee the continuous, uninterrupted or error-free operability of Simple Climb.
  10. Cancellation during Free Trial Period: If, after starting your free trial you decide to cancel, you have until the last day of the trial – the 14th day – to notify us by email, at hello@simpleclimb.com, to give us sufficient time to stop billing.
    1. Free Trial Cancellation Scenario:
      1. Jan 1: You sign up your 14 day free trial. This is Day 1 of your Trial.
      2. Jan 14: Last day of the Free Trial, and the LAST DAY to cancel prior to Billing.
      3. Jan 15: Billing for the forward month (Jan 15th – Feb 14th) is processed.
  11. Cancellation after Billing has commenced: To cancel your account at any point after your free trial has ended, email us at hello@simpleclimb.com at least 2 days prior to the next billing cycle.
    1. Billing Cancellation Scenario:
      1. Jan 15: Billing is processed for the January period of Jan 15 – Feb 14.
      2. Feb 13: the LAST DAY to notify us to cancel, and prevent the Feb 15 billing, for the February period.
      3. Feb 14: Cancellation of service on Feb 14 is not sufficient notice to prevent billing cancellation for the February period, but will stop your March billing. During the February period, our service will continue to work to grow your Instagram.  
  12. If you cancel your user account, or if your user account is terminated by Simple Climb, for any violation of the terms contained herein, we pledge to remove and delete any and all of your personal user login information. The foregoing paragraph shall not relieve you of owed payments or constitute a waiver of any existing breaches to the terms contained herein.
  13. We pledge to cancel your service and terminate all future billing the moment we receive your notification of cancellation. By signing on with Simple Climb, you pledge that you’ve read all the terms and conditions, that you understand the services are offered on a best-effort basis, and as a result, you acknowledge that any credit card charge disputes – done prior to, or instead of the normal cancellation process – are fraudulent disputes. Just tell us you wish to cancel, and we’ll cancel. Simple.
  14. The Terms of Service herein, as well as any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Ontario, Canada.
  15. Credit card information is always encrypted during transfer over networks.
  16. Certain content, products and services available via our Service may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
  17. We reserve the right to terminate your use of the Service or any related website. Unless otherwise stated, Simple Climb and any registered licensors are the sole owners of any and all of the contents, material, and intellectual property of Simple Climb. All intellectual property rights are reserved.
  18. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
  19. We reserve the right to modify, suspend or withdraw the whole or any part of our service or any of its content at any time without notice and without incurring any liability.
  20. If the terms and conditions ever change, we pledge to notify you by email. It is your sole responsibility to ensure that the email we have on record for you is active, and to stay updated on any changes.
